1. Who we are

BE VISIBLE MARKETING LLC operates this website at bevisibleagency.com. Our registered address is 30 N Gould St Ste R, Sheridan, Wyoming 82801, United States. In this policy, "we", "us" and "our" refer to BE VISIBLE MARKETING LLC. You can reach us at any time at rick@bevisibleagency.com.

2. Information you give us

We collect information you choose to provide through the contact form, including:

  • Your name, work email and role
  • Your company name and website
  • Your company size and timeline
  • What you need help with
  • How you heard about us, including which AI assistant or search engine and what you asked it if you tell us
  • Your availability preference and your browser timezone
  • Anything you write in the message field
  • Whether you opted in to our newsletter
  • Any information you share with us in the course of a client engagement

3. Information collected automatically

Analytics cookies from Google Analytics and Microsoft Clarity only run after you accept analytics cookies in our consent banner. Rybbit collects aggregate usage statistics without using cookies and stores nothing on your device.

Separately, when you submit the contact form we record the page you submitted from, the referring website if your browser sends one, any campaign parameters in the URL, your locale and timezone, and a one-way salted hash of your IP address used only to rate-limit spam. The form itself sets no cookies and stores nothing on your device, so it works even if you decline cookies.

4. Session replay and heatmaps

Microsoft Clarity may record a playback of a visit, covering mouse movement, clicks, scrolling and the pages you view. We use this only to find usability problems and improve the site.

Everything typed into form fields and dropdowns is masked by Clarity and cannot be seen by us. Numbers and email addresses shown in page text are masked too. This only happens if you accept analytics cookies, and you can withdraw that consent at any time from the cookie banner.

5. Cookies

We use cookies and similar technologies. Our banner asks for your choice before any non-essential cookie is set. Full detail on each cookie, what it does and how long it lasts is in our Cookie Policy.

6. How we use your information

We use the information described above to:

  • Respond to your enquiry and arrange calls or meetings
  • Provide, deliver and improve our services to clients
  • Understand how visitors use the site so we can make it better
  • Send you information you have asked for
  • Keep records we are required to keep, and to establish or defend legal claims

We do not sell your personal information. We do not share it with advertisers.

7. The basis on which we handle your information

Where the law requires us to identify a basis for handling your information, we rely on the following:

  • Your consent, for analytics and functional cookies, and for any marketing communications
  • The performance of a contract, where you are a client or are becoming one
  • Our legitimate interest in operating, securing and improving our business and this website, balanced against your rights
  • Compliance with legal obligations

You may withdraw consent at any time without affecting anything done before you withdrew it.

8. Service providers we share information with

We use a small number of third party providers who process information on our behalf:

  • Google Analytics, for website usage statistics
  • Microsoft Clarity, for heatmaps and session replay
  • Rybbit, for cookieless usage statistics
  • Resend, which delivers our email notifications and the confirmation we send you
  • Supabase, which hosts the database where contact form enquiries are stored, in the European Union
  • Slack, where new enquiry notifications are posted to our internal channel
  • Clutch, for displaying verified client reviews
  • Our website hosting and business email providers

Each provider only receives what it needs to perform its function. We do not permit them to use your information for their own purposes.

9. International transfers

We are based in the United States and our providers may store and process information in the United States and other countries. Where information is transferred across borders, we take reasonable steps to ensure it remains protected to the standard described in this policy.

10. How long we keep information

We keep enquiry and lead information for 24 months after our last contact with you, unless you ask us to delete it sooner or we are required to keep it longer. Client records are kept for as long as the engagement continues and for a reasonable period afterwards for accounting and legal purposes. The hashed IP address is kept with the enquiry record purely as a spam control and cannot be reversed to identify anyone. Analytics and session replay data is retained according to each provider's own retention settings.

11. Your rights

Regardless of where you are located, we extend the following rights to every visitor:

  • Access: ask us for a copy of the information we hold about you
  • Correction: ask us to fix anything inaccurate
  • Deletion: ask us to delete your information
  • Portability: ask us to send you your information in a portable format
  • Objection and restriction: ask us to stop or limit certain uses
  • Withdraw consent: change your cookie choices at any time using the banner, or unsubscribe from any email we send

To exercise any of these, email rick@bevisibleagency.com. We will respond within 30 days. We will not charge you or treat you differently for asking.

12. Security

We use reasonable technical and organisational measures to protect your information, including encrypted connections, access controls and reputable service providers. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

13. Children

This website is intended for business audiences and is not directed at children. We do not knowingly collect information from anyone under 16. If you believe a child has given us information, contact us and we will delete it.

14. Do Not Track

Some browsers send a Do Not Track signal. There is no common standard for how sites should respond, so we do not currently respond to those signals. Our cookie banner gives you direct control instead.

15. Links to other sites

This site links to other websites, including client sites and review platforms. We are not responsible for their content or their privacy practices. Read their policies before sharing information with them.

16. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. If we make a significant change we will make that clear on this page.
